Part A: Job Specification

Job Purpose
- Management and resolution of major claims submitted by offshore contractors and LLI suppliers.

Reporting and Relationships
- Reports to: Head of Contracts.
- Direct reports: None.

Internal
- Frequent contact with the Offshore Projects Management Team.
- Periodic contact with the Major Projects Team.

External
- Frequent contact with other departments and groups e.g. Legal, Supply, Finance, Performance & Delivery (P&D) and EPCI/FEED/LLI Contractor Representatives.
- Frequent contact with Contractors' PMT.

Job Context & Major Challenge(s)
- Leads review of major contractual claims relating to Offshore EPCI/FEED/LLI Contracts for Jackets, Topsides and Pipelines facilities.
- Provides contractual advice to the Project Management Team (PMT) with respect to amicable resolution of disputes through negotiation/mediation, with the aim of avoiding escalation of disputes.
- Responsible for the dispute resolution process on a multi-billion USD project.

Key Job Accountabilities
1. Advises Offshore Project Management Team (PMT) on handling of major claims and negotiations with EPCI/FEED contractors and LLI suppliers, interfacing with Legal, Supply, Finance, P&D departments and other stakeholders, as needed.
2. Develops dispute resolution strategies and work plans and advises on Risks and Opportunities.
3. Meets face-to-face with contractor to permit contractors to present their claims.
4. Thoroughly reviews and evaluates contractual claims (Entitlement, Causation and Quantum) and engages with the Legal Department and other stakeholders to align on Company position for response.
5. Reviews all correspondence and develops Company view (position paper) of potential claims in coordination with PMT, P&D and Legal.
6. Ensure compliance with Company's procedures, policies & regulations for dispute resolution and compliance with statutory requirements and Applicable Law.
7. Periodically updates the Major Projects Master Claims Register for Company's senior management.
8. Support facilitation and resolution of disputes to avoid escalation of disputes to formal arbitration/litigation.
9. Prepares Management and Governance claims recommendations and presentations, materials, Forms of Consent/Deeds of Settlement in conjunction with the Legal, P&D and PMT for formal closure and settlement of disputes.

Part B: Person Specification - Minimum Requirements

Qualifications
- Bachelor's Degree in Quantity Surveying, Law, Business Administration, Engineering.

Knowledge and/or Experience
- 8 years experience in business related function or discipline, including 4 years in the Oil & Gas Industry, and including 1 year experience in a supervisory or acting role, or oversight of contractor/subcontractors/service/vendor personnel.
- Member of Chartered Institute of Arbitrators (CIArb) preferred.
- Experience in administration of contracts and claims management relating to EPCI contracts in the Offshore Oil & Gas sector including Large Scale development.
- Proven track record in successful amicable resolution of contractual disputes.
- Experience in formal dispute resolution processes e.g. mediation, binding arbitration, litigation.
- Knowledge of Middle Eastern legal statutes and civil codes preferred.

Technical and Business Skills
- A high level of proficiency in written and spoken English.
- Planning and Cost literacy (Primavera P6) preferred
- Outstanding negotiation and interpersonal skills.
- Ability to resolve complaints and concerns.
- Retain and demonstrate excellent attention to detail.
- Computer literacy involving the regular use of professional office applications.
- Previous hands-on experience in facilitation of mediation, arbitration and/or litigation.
- Understanding of formal arbitration processes e.g. Redfern Schedules, document discovery/disclosure, review of claimant statements of case and preparation of respondent's statement of defence, facilitation of expert witness statements, factual and expert witness preparation, liaising with legal representatives and legal counsel.
